Dear Patron:
I am pleased to you are interested in a copy of the NAMI PA Promo-videotape produced by NAMI
Pennsylvania (NAMI PA) in conjunction with Pat Summeral Productions. We developed the
videotape to effectively promote community awareness of our support of persons with mental illness,
to build our membership and to generate increased financial support for NAMI PA. I believe you will
find the videotape to be a professional product and am happy to offer you the opportunity to use the
videotape in your own promotional efforts. The tape is not long but the message is persuasive and
would be useful in presentations to the community and in orientations for new members. Any funds
generated through your use of the videotape would be retained to support local programs and
activities.
Our contract with Pat Summeral Productions for the production of the videotape includes certain
legal limitations on its use and distribution by NAMI PA. Of course, NAMI PA must assure that those
contractual restrictions apply to any subsequent use of the videotape by our patrons and affiliates.
Accordingly, by accepting the videotape, [patron/affiliate] agrees to the following:
[Patron/Affiliate] agrees not to use the videotape for any commercial purpose including but not limited
to any sale or resale of the videotape or any charge for viewing the videotape. [Patron/Affiliate] will
not broadcast the videotape on free or paid television or via the Internet, and will not use or promote
the use of the videotape in public service announcements. [Patron/Affiliate] will not use Pat Summeral’
s name or his image or likeness in any promotional activities or advertising or in any other way.
[Patron/Affiliate] agrees not to duplicate the videotape in whole or in part. Finally, [Patron/Affiliate]
agrees to indemnify NAMI PA, its directors and employees, against any claims, demands or
judgments, including attorney’s fees and expenses, arising from or related to the use or misuse of
the videotape by [Patron/Affiliate] contrary to the limitations set forth in NAMI PA’s contract with Pat
Summeral Productions and as set forth in this letter agreement.
Should you be unable to abide by these terms, please return the videotape to NAMI PA immediately.
While the enclosed copy is complimentary, additional copies may be purchased directly from NAMI
PA. Purchases of additional tapes will help NAMI PA defray the costs of the original production. Of
course, a donation to NAMI PA is possible and would be much appreciated. I hope that you agree
that the videotape is an accurate and meaningful portrayal of our collective commitment to the needs
of the mentally ill. If you wish to use the videotape, please acknowledge your acceptance of these
terms by signing and returning a copy of this letter to me.
